PROBLEMATIKA HUKUM NETRALITAS PRESIDEN DALAM PROSES PENYELENGGARAAN PEMILIHAN UMUM 2024

Netralitas Presiden dalam Penyelenggaraan pemilu menjadi penting untuk menciptakan penyelenggaraan pemerintahan yang Demokratis, sebab Presiden harus mengutamakan kepentingan publik dibandingkan kepentingan golongan tertentu. Namun dalam faktanya ditemukan berbagai ketidaknetralan Presiden dalam Pemilu 2024. Kajian ini bertujuan untuk mengkaji dua hal, yang pertama menguraikan problematika regulasi terkait netralitas Presiden dalam Penyelenggaraan Pemilu, dan kedua, mendalami problematika Pertanggungjawaban Presiden terkait netralitas dalam penyelenggaraan Pemilu tahun 2024. Penelitian ini dilakukan dengan metode penelitian doktrinal dengan menguraikan aturan-aturan hukum dan menganalisis berbagai fakta terkait ketidaknetralan Presiden. Hasil kajian menunjukkan: pertama, Problematika regulasi terkait netralitas Presiden dalam pemilu pada level Undang-Undang Dasar tidak atur secara tegas, dan pada level Undang-Undang juga belum ada pengaturan yang secara khusus melarang Presiden untuk berpihak, bahkan permasalahan utama Undang-Undang Pemilu justru melegitimasi keberpihakan Presiden di dalam Pemilu. Hal ini menjadi penyebab rusaknya demokrasi, terjadinya abuse of power, conflict of interest, pelanggaran constitutional ethics dan meruntuhkan penyelenggaraan Pemilu yang berintegritas. Kedua Problematika pertanggungjawaban Presiden berkaitan dengan netralitasnya dalam pemilihan umum 2024 baik secara hukum, politik maupun etik tidak ditegakkan, hal ini disebabkan karena secara hukum belum ada regulasi yang mengatur mengenai larangan keberpihakan Presiden untuk berlaku netral di dalam proses Pemilu.
