STRATEGI PERLINDUNGAN POHON PADA TAHAPAN KAMPANYE PILKADA 2024
Abstract
Penelitian ini bertujuan untuk menguraikan permasalahan pemasangan alat peraga kampanye (APK) pada pemilihan kepala daerah ditinjau berdasarkan hak-hak lingkungan hidup. Maraknya pemasangan APK di pohon berakibat pada terganggunya stabilitas kelestarian lingkungan hidup manusia dan melanggar hak lingkungan. Metode penelitian yang digunakan adalah doktrinal dengan pendekatan peraturan perundang-undangan, kasus, dan komparatif. Hasil penelitian menunjukkan bahwa pemasangan alat peraga dalam kontestasi Pemilu tahun 2024 telah memberikan warna buruk terhadap lingkungan dan dikhawatirkan akan berlangsung hingga Pilkada pada November 2024. Pada saat ini, mekanisme pemasangan APK di Indonesia belum diatur tegas dalam UU Pilkada dan aturan turunannya. Jika dianalisis, Pasal 30 ayat (9) PKPU 11/2020 tentang Kampanye tidak melarang menempatkan APK di pepohonan. Larangan penggunaan pohon hanya ditetapkan terhadap atribut berupa bahan kampanye jenis stiker. Permasalahan ini juga diperparah dengan sanksi yang tidak tegas terhadap pelaku pelanggaran kampanye saat ini. Akibatnya para calon yang mengikuti Pilkada kerap melakukan pelanggaran kampanye, termasuk penempatan APK yang tidak tepat. Jika dianalisis dengan studi komparatif, pengaturan perihal larangan pemasangan APK telah diatur tegas beserta sanksinya. Diperlukannya reformulasi hukum terkait pemasangan APK dan mempertegas sanksi pelanggaran terkait dengan lingkungan hidup. Melalui konstruksi hukum tersebut, kampanye dapat berlangsung berlandaskan prinsip environmental ethics sebagaimana yang tertuang dalam UU Lingkungan Hidup.
